The Violent Crime Control and Law Enforcement Act, 1994. Authored by Joe Biden. While this law hasn't directly led to mass incarceration, since it is at the federal level, it did lead to states adopting similar "tough on crime" laws, which do contribute to mass incarceration at the state level.

By 2003 half the states had passed three strikes laws, beginning with CA in 1994.

This mass incarceration disproportionally affects poor and minorities. But if you don't vote for Biden, then "you ain't black" or something.

This is not to mention the criminal justice atrocities of the former CA attorney general.
