She could be completely in the right but this lawsuit is going to do more harm than good to her image. It makes her look petty and desperate for money. I feel bad for her, it's obvious that she is getting terrible advice from her people.

shareIt's nothing more than a ploy by Heigl to get attention for herself. Her crap attitude killed her career. She won't win this lawsuit. this kind of thing (while not nessessarily right), has been done 1,000 times before. She was in a public place and she is a public figure. This doesn't even make it to court.
shareShe's supposedly going to donate it to her brother's foundation--minus her legal fees. Her "payment" will be the good press when she enlarges her brother's foundation.
It's a strong case. You can't use someone's image for commercial purposes without THEIR CONSENT.

I think it depends on the case, and under what conditions she was photographed.
An indirect example, it's an invasion of privacy under the law to photograph somebody on their private property, but legal to do so on public property
Instead of suing she should be filing for Chapter 11,perhaps?????
