LAW and Order episode- judge hinted to defense to use Substantive Due

Hi, I am new acolyte if L& O and despite i watched the all episodes for 3f or 4th time i still don;t have nice way to recall the episodes.

sometimes by transcripts, by key words.. as bulgarian i am not so familiar with English law, namely "strict scrutiny" substantive due process..amendments, but by episodes i have nice introduction, at least I am able find all this in Wikipedia

So, I am writing to You, demanding some assistance to recall an episode.
it goes like this-
the defense attorney wasn't so good (first criminal court case or something like that) so the judge, female hinted to him "so it is not 4th amendment ..what is next..the 3 words Substantive Due Process".

I realize that "Savages" is the episode where also we got this in appealing, but I think it is not this episode.

I will appreciate every hint!
thanks!
