Should I report my motorcycle as stolen?

6 months ago I sold my motorcycle to a guy, he paid for it in full, but we did not do a title transfer at the DMV. I've been contacting him every month to get it done, but he keeps delaying and now he wont return my calls at all. As I said, he did pay for it, but I don't really want him riding around on it when it's still registered to me, for which I'm legally liable. Should I file a stolen vehicle report with the police?

No, you're not, if you signed the title over then it is his responsibility even if he never registers it.

Also, when you sell a vehicle to a private party, immediately remove the tag, turn it back in to the DMV for a refund and tell your insurance company to get a refund on that also.

That's what I meant, I haven't transferred the title. He took the bike before I had a chance to remove the tag.

In that case you were careless. You could see if you could claim the tag as stolen and that might get you out of having to keep the bike registered and paying insurance as long as you don't re-tag the bike. However in order to claim the tag stolen you might need to file a police report and that could be tough with no bike present.

Did you work up a bill of sale for the bike between you two? That could act as proof possibly to help you in this situation?

I would contact either the DMV or talk to a local police officer to see what a recommended course of action is on their part.

reply

I'd contact my insurance company.
