Received my Car Registration Today And It Had Me Thinking

So with a new car registration in hand, the state of California also sent me a DUI-Lose Your License card. Obviously, everyone should know to not drink while driving.

Then I remembered watching Cops shows and how when someone was pulled over and thought to be over the limit, they were then asked to take a breathalyzer. Weird part was the Cops were so excited about the person blowing into it saying "Almost there..keep blowing keep blowing", as if they were doing the right thing. If they were over, it was almost always resulted in arrest.

Thing is, why should this be okay? One would feel as if they are basically shooting themselves in the foot in taking this test. I mean yes, what they did was illegal; however, if they did a good job in following through with the test, does it not seem like they should be penalized a little less than a person who refuses or does not continue to blow as long as they expect one to?

reply

No offense, arvin, but this is one of your dumber questions. The answer is no. Driving under the influence is illegal. The test is administered to determine whether or not someone is DUI. If you are, the penalty is what it is. If you refuse to take the test, you're usually arrested anyway and brought to the station because it can be construed as an admission of guilt. If someone fails a drug test, should they be hired anyway because they "did a good job" taking the test? In school, did you get better grades on tests you failed or did poorly on because you "did a good job" taking them?

reply

Well, arvin,in my country if you refuse the drug test, then the police has the right to take you on a hospital and take a blood sample without a warrant.

When you go to the DMV you will see that "95%" are "undateable" and that it's a leper colony.

Thank you. My life is complete.

Is that your best? Get off your high horse and make me believe.

Different states have different laws regarding DUI tests. I suspect that if you're uncooperative or combative about the situation you may face additional charges, but there are no bonus points for agreeing to take the test. You're either over the limit or you're not.

California? I thought you lived in Kentucky.

"Fruitcake anyone?"

reply

My vehicle is still registered in California because I am a student seeking further education in KY. It allows me to bypass a smog check that I would have to get done in California and it allows me to bypass registering my vehicle in KY.

reply

Ah, thanks. That explains so much.
