Don't think they can.

Since Universal Studios have made a movie out of it (Dune (1984)), they probably have the rights to it.

...This question was OBVIOUSLY written with the assumption that HBO could or would easily by the rights.

Syfy did 2 miniseries about the first 2 books,so if one WERE to happen,the best bet would be it would go to the Syfy channel.

I asked should a SPECIFIC TV network adapt those books into TV show and not about its plausibility or who would most likely ever do so.

Pretty sure there's a movie in the works as we speak. Denis Villeneuve rumored to direct.

Yes, heard that's either a done deal or close to it. Don't know anything about the Dune saga besides vague memories of the Lynch film but I'm excited to see anything from Denis Villeneuve.
