Is it possible for Jackson or someone else to....


Is it possible for Jackson or someone else to continue the story by creating a Hobbit/LOTR Cinematc universe (like Marvel, DC and Star Wars) or perhaps try to continue with Tolkien's The New Shadow proposed storyline:

Short answer no long answer it's complicated.

Regarding New Shadow anything based on that would have to have the permission of the copyright holders which would be the Tolkien Estate as it is unpublished and only mentioned in JRR's letters and they do not want or can not allow filming of any further of Tolkien's created Universe.

In regards to expanding on the LOTR's books you get into quite shaky legal ground in regards to what you are able to do so the difficulty of putting anything together which would pass legal muster in regards to copyright would be very very difficult indeed and certainly from a film studio's pov I would imagine not worth their time.

Perhaps in a 100+ years when the various copyrights have expired you can expect something to happen I will be long gone by that point though.

Not entirely true.

The surviving fragment of "The New Shadow" was published in Volume 12 of HoME. It has Beregond's younger son as the protagonist. Tolkien said something to the effect that its plot structure was looking like a typical mystery novel with Middle Earth trappings.

It is true that the Tolkien Estate would control it, and that would make any type of serious attempt at a film difficult.

Oh,lord! Why would we even want them to?

I would prefer someone with a little more restraint cover the Sil. Someone who isn't quite so enamored of lengthy battle scenes and CGI creatures, and more in love with the stories.

Have you ever read the existing fragment of The New Shadow?

Tolkien abandoned it for a reason...

If someone was trying to spin a new story out of a fragment, Tal-Elmar would probably be a better place to start, anyways.

Tolkien's universe is very different from that of Marvel or DC.
- In terms of writing, the comics have been churning out new storylines for many decades with repeated rewriting, reimagining and expanding the "worlds" in Marvel and DC.

Tolkien's Middle-earth writings are massive, done over many decades, with several volumes.
And unlike Marvel and DC, Tolkien didn't have to constantly put out more comics. Instead Tolkien repeatedly tried to make his universe a more consistent world in terms of geography and history (in greater detail).
For instance there are biographies of certain characters. There are locations around the globe plotted out over time with maps. All of it is very extensive.

And all those writings outside of The Hobbit and Lord of the Rings are controlled by the Tolken Estate.
And the Tolkien Estate currently does not want any films based in any way on Tolkien's other writings.

In terms of rights and control, the Star Wars situation is more similar to the rights issues with the Tolkien universe.
- Lucas used to have complete control of the Star Wars universe.
And he decided what was canon and with his legal powers he could stop any big studio Star Wars film that was trying to be made (or edtited) without his permission.
Only when Lucas sold his SW rights to Disney, could new big studio Star Wars film stories be imagined that were not controlled by him.
(But even today there are no plans to release the theatrical versions of the original Star Wars trilogy on Blu-Ray. Rights and control can prevent even basic things like that.)

* The Tolkien Estate owns the rights to "The New Shadow" excerpt.
Any big studio trying to film "The New Shadow" would be stopped by the Tolkien Estate.
Any attempt to make another big studio Middle-earth film based on new stories by other authors would almost certainly overlap with writings controlled by the Tolkien Estate (because those writings are so extensive).
Result; lawsuit.
No studio wants to deal with that hassle.
